The Pursuit of Accord

The hardest thing for any society to do is to avoid oppressing its least advantaged people. Politics everywhere is an insider game: people with political, economic, and social advantages make policy for their own benefit not just neglecting outsiders, but oppressing them. Most theories of justice understandably want to eliminate this insider-outsider problem by building a consensus around a true “social contract” or an undeniable sent of “natural rights.” Unfortunately, you can never get everyone to agree to anything. How can you eliminate the insider-outsider problem, if you can’t bring every outsider into consensus?

More than 200 years ago, Immanuel Kant gave the world an overconfident solution that, I would like to argue, has helped justify oppression ever since: create a basic social-political structure that, in Thomas Scanlon’s words, “no one could reasonably reject.”

Obviously, no matter how fair and just social arrangements are, some unreasonable people—call them recalcitrants—will reject them because of their selfishness, irrationality, or ignorance. But if we create a social structure that truly incorporates everyone’s needs or rights or concerns, we can effectively eliminate the insider-outsider problem even without a literal consensus. Any reasonable objectors—call them dissenters—will have been brought into the coalition.

If you could do such a thing, the social contract would resemble (if only superficially) an insider contract. Some people—call them the ruling coalition—would establish a basic structure. Other people would object. The ruling coalition would say that the objectors were unreasonable, and they would be right. The coalition would speak for the recalcitrants, truly bringing them inside the contract, knowing that if they were rational they would know (and if they were reasonable they would admit) that they are not really outsiders.

If the social contract of the reasonable looks so much like an insider contract, how will we know which it is? Most theories of justice try to bypass this how-do-we-know question by focusing on the what-do-we-do question. If we thought there were reasonable objections, we would change the basic structure to one that had no reasonable objections. Many philosophers have written extensive theories about the kind of structure that they believe could not reasonably be rejected.

Great. But then we’re in the same situation where the ruling coalition says its reasonable. How do we know that the ruling coalition is the one that’s reasonable and the objectors are the ones that are unreasonable rather than the other way around? No one is infallible. Philosophers make mistakes. So do ruling coalitions. One could reasonably characterize all of recorded history as the March of Folly of ruling coalitions. So, if we’re fallible, how will we know when and whether we’ve succeed in this great and worthy quest to create social arrangements “that no one could reasonably reject?”

Unfortunately, I want to argue that virtually all contemporary theories of justice are based on the overconfident assumption that the theorist who wrote it actually knows how to solve the insider-outsider problem.

The danger of a theory based on that piece of overconfidence is revealed by the answer to this question, who must we convince that we’ve created a structure “that no one could reasonably reject”? The only possible answer is that the ruling coalition only has to convince itself. They have to treat potential objectors well enough to keep them from rebelling, but they don’t really have to justify the structure to anybody; they don’t have to get objectors to agree to anything, because they can dismiss them as “unreasonable.” My reading of recorded history indicates that insider coalitions can be incredibly unjust without doubting their own reasonableness or creating a serious risk of rebellion. (For example, the Texas state legislature once passed a resolution claiming, “the servitude of the African race … is mutually beneficial to both bond and free.”)

Modern philosophers can reasonably claim that they are far more reasonable than the 1861 Texas Confederate state legislature, and they can propose a structure that gives voice and concern to many out groups, but they are dangerously overconfident if they ignore this observations that I believe our obvious: A privileged majority can never speak for an underprivileged minority. A male-dominated government can never claim to speak for women. A white majority can never speak for black or any other non-white minorities. A Christian majority can never claim to speak for non-Christian minorities. A secular majority can never claim to speak for religious minorities. A heterosexual majority can never claim to speak for queer minorities, and so on and so on.

The insider majority must give out-groups voice and try to accommodate their concerns, but the majority also has to rule, and they will make mistakes that advantage insiders over outsiders. The job will never be done. Justice is in the pursuit of accord, not in the assumption that we’ve done enough, and objectors are just unreasonable.

My latest academic article, “The Pursuit of Accord: Toward a Theory of Justice with a Second-Best Approach to the Insider-Outsider Problem,” discusses this issue at greater length. It gives ten reasons to believe that all ruling coalitions are insider coalitions rather than true “social contracts.” It discusses four strategies to create consensus, and argues that although they must be tried, they’re likely to fall short of establishing a genuine consensus even if everyone is reasonable.

Finally, it discusses an alternative theory called “justice as the pursuit of accord” (JPA), which offers a second-best approach to the insider-outsider problem under the working assumption that consensus is impossible to achieve even if everyone is rational and reasonable. The ruling coalition has to make the laws, but it can never presume to speak for dissenters. It must both try to get as many people into accord as possible and try to minimize negative interference with people who can’t be brought into accord. Basic Income plays a significant role in the minimization of negative interference and other aspects of JPA. My earlier book, Freedom as the Power to Say No, outlined JPA’s theory of freedom. My article (“The Pursuit of Accord”) and the future book I’m hoping to develop from it will discuss JPA as an overall theory of justice and outline its accompanying property theory.

The structure of the Conference has been updated.

BIEN Civic Forum will be held on the 22nd of August. On this day, having been called “India Day”, two major plenary discussions will be held: one that focuses on the Indian state of Telangana and its policy initiatives related to basic income, and a second one about the more general debate at the Indian national level.

As for the Thematic Areas for Plenary Sessions, these have been improved and detailed, as follows:

Exploring different ideological perspectives and worldviews that see an unconditional Basic Income as a desirable component of a more equitable and inclusive society

What implications and impact would basic income have on the lives women who constitute more than half of the global population? Can we talk of a sustainable society as long as we steal labor from women? Can an unconditional basic income remedy this structural inequity?

  1. Is Basic Income the Foundation of a Caring Economy and Society?

Is it possible to build an economy and a society that is based on values of caring, sharing and partnering rather than power, domination and control? Is an unconditional basic income an essential ingredient of such a society?

  1. The Emancipatory Potential: What forms of Freedom and what kind of Community Life does Basic Income promote?

Basic Income experiments across the world have demonstrated repeatedly that an unconditional basic income has a strong emancipatory effect of its recipients.  It loosens the constraints of existence and liberates the mind to seek a life and a community better than what we have now. What implications does this freedom and emancipation have on us and the communities that we dwell in?

  1. Basic Income, the Commons and Sovereign Wealth Funds

Our society privileges and celebrates private inheritance, but it equally turns invisible what can be called our public inheritance, and the fact that it is people who own natural resources and the state is just a custodian. This perspective if implemented can radically transform the way we view, manage and account for our natural wealth and endowments.

  1. BI Pilots: Opportunities and Limits of Evidence

In both the low-income countries and in high-income countries, there have been basic income pilot studies. While we already have the results of some of the studies, by mid-2019, we are likely to have more results. The Congress will deliberate both the results and also what they can achieve in terms of policy change

  1. Basic Income and Political Action: What does it take to transform and idea into policy?

It is one thing to have strong evidence from pilot studies and something else to get the acceptance of the policy makers and persuade them to act on it. There have been some pioneers among politicians and policy-makers across continents who have taken the plunge and implemented different versions unconditional income transfers, inspired by the spirit of the idea of basic income. Do we see them as first steps towards a full UBI? Or as distortions of the idea?

  1. Development Aid and Corporate Philanthropy: Is Basic Income a Better Paradigm and Way Forward?

In recent years, there has been a great deal of rethinking about the effectiveness of the current paradigms of giving aid either to countries or to communities. Unconditional Basic Income is increasingly emerging as a radical alternative to conventional notions of giving aid. We witness this shift as much within the UN think-tanks as that of corporate philanthropy.

There will also be a Short Films Exhibition, organized in partnership with Grundeinkommen Television (Gtv), which a is part of the Initiative Grundeinkommen, a pioneering civil society initiative established in 2008. Guidelines for submission:

  1. The length of the Film should be below 15 minutes;
  2. Your film should be made in 2018 or 2019 and be shown for the first time to a wider audience at the Congress;
  3. The film should be in English or with English subtitles;
  4. Entries should reach latest by 1st June 2019;
  5. A committee appointed by INBI will select the entries for exhibition at the Congress;
  6. Two of these selected films will be jointly rewarded INBI Short Film Prize of 500 US Dollars each.

The Call for Papers for the 19th Basic Income Earth Network (BIEN) Congress, in Hyderabad, India, has been released. From the 22nd through the 25th of August 2019, scholars, community organizers and artists are invited to make presentations pertaining to any of the following thematic areas. The abstracts (maximum 500 words) must reach the Local Organizing Committee by February 25th 2019. Congress Theme: Basic Income as Freedom and Development

The theme of the Congress is ‘Basic Income as Freedom and Development’. Basic Income is an idea that is evoking curiosity and attention of people from a wide variety of national and cultural contexts, from leaders of different socio-political domains. Irrespective of the generic meaning that we attempt to give it, the groundswell that we witness today is producing its own local meanings. Each of these meanings seems to emerge from its own unique contextual starting point. The year 2019 is virtually being declared as the ‘Year of the Basic Income’, because the idea is reverberating across the world.

In this chaotic multiple renderings and interpretations, we observe that Basic Income is being seen both as Freedom and Development. These two notions are not mutually exclusive or distinctively apart, as often they are made out to be. Development ideally ought to lead to Freedom, and equally so the other way round.  In certain contexts, the immediate appeal of the idea of Basic Income seems to be ‘Development’ in terms of addressing hunger and other forms of deprivation, access to education and healthcare. In other contexts, the immediacy may be felt as Freedom from alienating jobs that most of us are forced to do for a living. In either case, what emerges is that an unconditional Basic Income is seen as having tremendous potential to liberate us from the new forms of slavery that the current phase of capitalist economy subjects us to.

BIEN Civic Forum

The Congress will be held for four days. The first day, on the 22nd August, will be India Day which is being organised under the new BIEN initiative Civic Forum. The deliberations of this day will focus on the Basic Income debate and policy initiatives and the ground level experience in India. All the delegates are encouraged to attend the India Day. The main Congress will be inaugurated on 23rd morning and will conclude at 2:45 pm on 25th August 2019. The General assembly of BIEN will be convened at 3 pm on the 25th August 2019.

PODCAST: Floyd Marinescu talks about basic income on Canadian CBC Radio

Floyd Marinescu, a Canadian entrepreneur who describes himself as “an angel investor, author, humanitarian, and homosapien”, is featured in this interview, on CBC Radio, which has been condensed into a Whiteboard animation. Floyd has been a long-time defender of basic income, from a business perspective. According to him, the rise in aggregate demand which basic income will generate, is just what business needs to flourish. Paying for a basic income would also be fairly straightforward, Floyd reasons, especially when you realize that it’s net cost that matters, not gross cost. Financing would then come from closing redundant welfare programs, resolving tax loop holes, moderate rises in income tax and a series of other tax revenues (e.g.: carbon emissions, financial transactions, natural resources extraction, intellectual property).

 

Marinescu talks about “compassionate capitalism”, which builds on innovation and entrepreneurship, but also redistributes corporate gains to the whole of the population, so that “the working poor don’t need to be destitute”. For him, basic income also means freedom, personally and professionally, given the high number of people clearly mismatched with their current jobs, since it would allow them to make the necessary changes in their lives. Basic income would also allow more risk-taking, which is essential for entrepreneurship. Overall, according to Marinescu, basic income would be a great economic stimulus for Canada, putting more money into circulation, benefitting most people and also the government, which would collect more taxes to spend on public goods and services.

Sweden: MP Rebecka Le Moine introduces a motion in Parliament for the investigation of basic income

The Member of the Swedish Parliament (MP), and Green Party representative Rebecka Le Moine has submitted, on the 30th of November 2018, a motion for the deep investigation of basic income in Sweden. Rebecka, a 28 years old ecologist particularly dedicated to natural conservation issues, is a member of both the committees on Taxation and Environment and Agriculture.

 

The motion itself doesn’t go into a large detail about basic income itself, although it does provide a firm justification to pursue with deeper studies related to it. For instance, it refers to John Maynard Keynes’s predictions of a 15-hour working week, and the generalized usage of automation to replace most repetitive and/or too demanding (or dangerous) jobs. It also names Martin Luther King, particularly his voicing on eradicating poverty through the introduction of unconditional cash transfers. The most notorious basic income experiments around the world – Namibia, Finland, Canada, India – are also mentioned, as a way to contextualize the motion and show-reel some of the advantages of basic income (on an experimental setup).

 

The motion also draws on a human-rights approach to basic income, by referring to the United Nations Charter of Human Rights. Concretely, it appeals to article 22, where it says that all members of society shall have the right to a dignified life, according to each country’s capacity. The United Nations Sustainable Development Goals are also referred to, since these call for poverty eradication and equal rights to financial resources for all people.

 

On a more personal level, the motion justifies studying basic income deeper on the experimental fact that people get more creative and less risk-aversive when given unconditional money. It also testifies for the relation between freedom and civility, democracy and conscious environmentalism. More secure and less needy people are also more amenable and generous. It goes on to add that unconditional money equates to a power shift from society’s main institutions – governments, corporations, churches, ONG’s – to the individual, who gets a higher ability to say no to oppressive work and life conditions, or yes to tasks or life paths which are not sufficiently valued nowadays. That, of course, leads to major disruptions in the labour market and generalized social constructs.

 

As for financing, the motion swiftly mentions international prized economists who affirm basic income is affordable. That affordability can come from cost savings, with the reduction or elimination of certain conditional social benefits, together with increased taxes on the extraction of natural resources, carbon emissions, fortunes and on the financial sector.
